Terms of Service

These Terms of Service ("Terms") govern your access to and use of the voxite service (the "Service"), operated by Individual Entrepreneur Prusov Dmitry Aleksandrovich (Russian: ИП Прусов Дмитрий Александрович, INN 504212647947, OGRNIP 318500700004187), registered in Russia at 127221, Moscow, Shokalskogo passage, bld. 37, building 1, apt. 69 — referred to below as "we", "us", "our".

By creating an account, topping up your balance, or generating a website via the Service, you confirm that you have read, understood, and agreed to these Terms in full, including the Early Access notice (Section 2), the AI Disclaimer (Section 3), the No Warranties clause (Section 8), and the No Refunds policy (Section 9).

If you do not agree, do not use the Service.

1. The Service

voxite is an AI-powered website generator. Users interact with the Service primarily through a Telegram bot (@voxite_bot) and receive hosted websites under subdomains of voxite.app (e.g., yourbrand.voxite.app).

Each website is produced by passing a brief (user-supplied description, photos, brand assets) to large language models (currently Anthropic Claude) and post-processing the output into a deployable Next.js project.

2. Early Access / Active Development — IMPORTANT

voxite is a young service in active development. By using it, you acknowledge:

  1. We are in an early-access phase. The Service is functional but evolving. Features are added, refined, removed, and rebalanced regularly. Behaviour you experience today may differ from behaviour next month.
  2. Current capability: beautiful sites. Today the Service generates visually polished single-page websites from your brief. Layouts, animations, imagery, and copy come from AI.
  3. Current limitations (non-exhaustive list of what we do not yet offer, but plan to add):
    • Full SEO module — automatic meta tags, JSON-LD, sitemap, robots are partially implemented but not yet client-controllable
    • Admin panel — visual editor for non-technical users (Phase 8 in our roadmap)
    • Form builder — lead-capture forms with CRM integration (Phase 6 in progress)
    • Multi-page architecture beyond the main page (early support available)
    • AI-assisted content editing (Phase 9)
    • Custom domain attachment beyond *.voxite.app subdomains (early support available, see Section 5)
    • A/B testing, analytics dashboard, conversion tracking
    • Multi-language site generation
    • E-commerce features (cart, checkout, product management)
  4. Your balance does not expire. Funds you top up today remain in your account indefinitely (subject to the limits in Section 12 — Termination). As we ship new modules — SEO controls, admin panel, forms, multi-page, custom domains — your existing balance can be used against them without additional purchase.
  5. You are an early adopter. You accept that the Service of today is not the Service of tomorrow, and that the price-to-feature ratio will improve over time. Paying now and using balance over multiple months as features ship is the intended usage pattern.

If you are looking for a fully mature, feature-complete website builder with an SLA, this is not it. Use the Service only if you are comfortable with these early-access conditions.

3. AI Disclaimer — IMPORTANT, READ CAREFULLY

The Service uses generative artificial intelligence. By using it you acknowledge and accept:

  1. Output is non-deterministic. Two identical briefs may produce different results. The same brief run twice will not produce identical websites.
  2. Output may not match your expectations. Layout, copy, imagery, animations, colour palette, fonts, and structural decisions are made by the AI based on your brief. The result may differ — partially or significantly — from what you imagined.
  3. Output may contain mistakes. AI may misinterpret your brief, hallucinate facts, place wrong elements, generate broken or aesthetically poor sections, or produce technically suboptimal code.
  4. No guarantee of quality, suitability, or fitness for any purpose. We do not guarantee that the generated website will be commercially successful, convert visitors, rank in search engines, comply with industry-specific regulations, or be free of defects.
  5. You pay for the generation process, not for a specific outcome. Each AI generation consumes real resources (Anthropic API tokens, our compute, our infrastructure) that are billed to us in real time regardless of whether you like the result. You pay for that work, not for a promise of a beautiful site.
  6. Iterations are part of the workflow. If the first result does not match your needs, you may regenerate, edit blocks, or change effects — each iteration is a separate paid operation.

You agree that you are using the Service with full understanding of how generative AI works and at your own risk.

4. Account & eligibility

  • You must be at least 18 years old to use the Service.
  • You must have a valid Telegram account.
  • You are responsible for keeping your Telegram account secure.
  • You are responsible for all activity that happens through your Telegram user ID, including charges to your balance.

We may suspend or terminate accounts at our sole discretion if we detect abuse, illegal content, fraud, chargebacks on valid charges, or attempts to disrupt the Service.

5. Pricing & payments — prepaid balance

The Service uses a prepaid balance model. Balance is denominated in US Dollars (USD) internally and topped up via one of three payment processors:

  • YooMoney (ЮKassa) — Russian cards, СБП (Faster Payments System), YooMoney wallet. Top-up in RUB, converted to USD balance at the prevailing rate displayed in the bot at the moment of top-up.
  • NowPayments — crypto payments (BTC, ETH, USDT, USDC, and 350+ other currencies). Top-up in USD-equivalent crypto, credited as USD balance after on-chain confirmation. Operates in custody+auto-conversion mode (see Privacy Policy §5.3).
  • Stripe — currently test-mode only, not available for live top-ups as of the effective date. Will be enabled for non-RU users (USD/EUR cards) when business documentation is finalised.

Minimum top-up: USD 25 (or RUB-equivalent at the displayed rate) per transaction.

All top-ups are final sale, subject only to the limited exception in our Refund Policy.

Custom domain (hosting slot)

If you connect your own domain to a generated site, a separate hosting slot fee of USD 5 / month applies, billed daily from your prepaid balance. As long as your balance is positive, the custom domain stays active. If balance drops below USD 0, the domain reverts to the default *.voxite.app subdomain (the site itself stays online).

How charges work

Every AI generation, edit, regeneration, effect application, redesign, or related AI-powered operation incurs a real underlying cost from our AI provider. We charge 2× the underlying AI cost to your prepaid balance.

Example: if a website generation costs us USD 3.50 from the AI provider, your balance is reduced by USD 7.00.

A small negative balance is permitted during an active operation so that a long generation is not aborted mid-way. Your next top-up will first cover any negative balance.

You can view your balance, top-up history, and per-operation spending via the bot command /spending or the 💰 Balance menu button.

What the 2× markup covers

The markup covers:

  • AI API costs (Claude Sonnet / Opus / Haiku models)
  • VDS hosting of your generated site at <slug>.voxite.app
  • SSL certificate (wildcard Let's Encrypt, auto-renewed)
  • Storage of source files and version archives
  • Best-effort technical support

It does not cover: custom design, manual edits by humans, copywriting, SEO consulting, marketing, advertising, content moderation by humans, or any service we do not explicitly offer.

Prices may change

We may adjust the markup multiplier, minimum top-up amount, or pricing structure at any time with 30 days' notice posted on voxite.app. Existing balance is honoured at the rate at which it was added.

6. User content & responsibility

You retain ownership of the brief, photos, brand assets, and other content you submit. By submitting, you grant us a non-exclusive, royalty-free, worldwide, sub-licensable license to use this content solely to provide the Service to you: passing it to AI providers, generating sites, hosting them, and storing version history and operational logs.

You are solely responsible for ensuring that the content you submit does not:

  • Infringe any third party's copyright, trademark, patent, trade secret, or other intellectual property right
  • Violate any applicable law, including (but not limited to) laws regarding hate speech, child sexual abuse material, terrorism, illegal drugs, illegal weapons, fraud, deception, defamation, or spam
  • Contain personal data of any third party that you do not have lawful permission to share

We do not pre-moderate content. We do not review generated sites for accuracy or legality. You accept full responsibility for the final published content, including any AI-generated text, imagery, or markup served from your subdomain.

We reserve the right to remove a generated site, refuse further generations, or terminate your account if we identify or are informed of a violation.

7. Generated sites — hosting & ownership

  • Generated sites are hosted on our VDS infrastructure under <your-slug>.voxite.app.
  • Source files (TSX, assets, exports) are stored on our servers and accessible to you on request via support contact.
  • We retain a right (but not an obligation) to host your sites for as long as your account is active and your balance allows.
  • We may take a hosted site offline at any time if it violates these Terms or if our infrastructure costs cannot be sustained.

8. No Warranties — Service provided "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION:

  • WARRANTIES OF MERCHANTABILITY
  • WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF NON-INFRINGEMENT
  • WARRANTIES OF ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF AI-GENERATED OUTPUT
  • WARRANTIES OF UNINTERRUPTED OR ERROR-FREE OPERATION
  • WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, EXPECTATIONS, OR BUSINESS GOALS

You acknowledge that AI-generated output is inherently unpredictable and that no website generation will be free of imperfections.

9. Refunds, chargebacks & disputes

Detailed terms in our Refund Policy. Summary:

  • Used balance is non-refundable. Once your balance has been spent on an AI operation, the underlying resources have been consumed and cannot be reversed.
  • Unused balance may be refundable in a limited window — see Refund Policy.
  • Chargebacks on valid charges will result in immediate account termination and may be disputed by us with documentary evidence (Telegram logs, AI operation records, deployment confirmations). You agree not to file a chargeback for a charge that has been delivered as described.
  • All payment disputes must first be raised with our support team before any chargeback is filed.
  • Crypto top-ups (NowPayments) are irreversible by nature of the blockchain. Refund for unused balance topped up via crypto is processed in stablecoin to a wallet address you provide.

10. Service availability

We aim for high availability but make no SLA commitment. Causes of downtime may include AI provider outages, hosting provider outages, DNS issues, network failures, planned maintenance, security incidents, or force majeure. We are not liable for losses (direct, indirect, or consequential) resulting from Service unavailability or interruption.

11. Third-party services

The Service relies on third-party providers, including but not limited to:

  • Anthropic (Claude AI models)
  • Cloudflare (DNS, SSL for the apex domain, custom hostnames)
  • YooMoney (ЮKassa) (RUB payment processing)
  • NowPayments (crypto payment processing)
  • Stripe (card payment processing — test-mode only as of effective date)
  • Telegram (user interface)
  • Resend (transactional email for form leads)
  • VDSina (server hosting)

We do not control these third parties. Their availability, terms, and policies may change. We are not responsible for outages or actions of these third parties.

12. Termination

You may stop using the Service at any time. Your account remains in our database with any remaining balance until you request deletion.

We may terminate or suspend your account immediately, without prior notice, if you:

  • Violate these Terms
  • Submit illegal content
  • File a chargeback on a valid charge
  • Behave abusively toward support staff
  • Attempt to reverse-engineer, scrape, or abuse the Service
  • Use the Service to generate sites for parties subject to international sanctions

Upon termination, hosted sites will be taken offline after a 7-day grace period. Any positive balance is forfeited unless you request a refund of unused balance within 14 days of the most recent top-up and meet the conditions in our Refund Policy.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Our total cumulative liability to you for any and all claims arising out of or relating to these Terms, the Service, or any AI-generated output is STRICTLY LIMITED to the total amount you have paid us in the THREE (3) MONTHS preceding the event giving rise to the claim, and in any case capped at USD 200.

WE ARE NOT LIABLE FOR: lost profits; lost revenue; lost business opportunities; lost data; business interruption; reputational damage; emotional distress; or any indirect, incidental, special, consequential, or punitive damages — even if we have been advised of the possibility of such damages.

This limitation applies regardless of the legal theory of recovery (contract, tort, statute, or otherwise) and survives termination of these Terms.

14. Indemnification

You agree to defend, indemnify, and hold harmless us, our officers, employees, agents, and contractors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Content you submit to the Service
  • Your use of any AI-generated output
  • Your violation of these Terms
  • Your violation of any third party's rights or any applicable law

15. Changes to these Terms

We may update these Terms at any time. Material changes will be announced on the landing page and via Telegram bot message at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service before the effective date.

16. Governing law & disputes

These Terms are governed by the laws of the Russian Federation, without regard to conflict-of-laws rules.

Any dispute shall be resolved exclusively in the courts of Moscow, Russian Federation, except where mandatory consumer protection law of your country of residence applies.

You waive any right to participate in class actions or collective proceedings against us.

17. Entire agreement

These Terms (together with the Privacy Policy and Refund Policy) constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings.

If any provision is held unenforceable, the remaining provisions remain in full force.
